1. Agreement to Terms
These Terms of Service ("Terms") are a legal agreement between you ("User," "you," or "your") and Decoded Systems, LLC ("Company," "we," "us," or "our"). By accessing or using any of our products, services, websites, or platforms (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Description of Services
Decoded Systems, LLC offers a range of products and services, including but not limited to:
- Software Products: Ready Path (personal minimums and flight readiness assessment), ClearPath (aviation preflight decision support), Proficiency Path (pilot education and proficiency management), and Oryn (legal case management and workflow)
- WaveSuite Media Production Products: CastWave (AI-powered podcast production), PostWave (AI-powered social media production), and FlowWave (AI-powered video production) — collectively referred to as the "WaveSuite" platform
- Media Content: Podcasts, educational deskbooks, and monthly magazine publications
- Related Services: Consulting, education, and customer support
3. Important Disclaimers
3.1 ClearPath Aviation Decision Support Tool
ClearPath is a decision support tool designed to assist with preflight planning and risk assessment. ClearPath does not replace pilot judgment, aeronautical decision-making, or the authority and responsibility of the pilot in command. You acknowledge that flying is inherently risky, and final decision-making authority rests solely with the pilot in command. ClearPath is a supplemental tool only and should not be relied upon as a substitute for proper training, currency, and sound aeronautical judgment.
3.2 Proficiency Path Educational Supplement
Proficiency Path is an educational and proficiency tracking tool that supplements, but does not replace, certified flight instruction from qualified instructors. Proficiency Path does not constitute flight training, ground training, or flight instruction, and is not a substitute for formal flight training, recurrent training, or check rides required by federal aviation regulations. Users must obtain all required training from certificated flight instructors and follow all applicable regulatory requirements.
3.3 Oryn Legal Case Management Tool
Oryn is a workflow and case management tool for legal professionals. Oryn does not provide legal advice and is not a substitute for consultation with a qualified attorney. Users of Oryn are responsible for ensuring compliance with all applicable laws, ethics rules, and professional standards in their jurisdiction. The Company provides no warranty regarding the legal sufficiency or appropriateness of any work product created using Oryn.
3.4 WaveSuite AI-Powered Media Production Tools (CastWave, PostWave, FlowWave)
CastWave, PostWave, and FlowWave (collectively, "WaveSuite") are AI-powered content production tools that use artificial intelligence, including third-party AI services, to generate scripts, voice audio, social media posts, video content, and other materials on your behalf. You acknowledge and agree to the following:
- AI-Generated Content: Content produced by WaveSuite products is generated using artificial intelligence and should be reviewed by you before publication. You are solely responsible for the accuracy, legality, and appropriateness of any content you publish using WaveSuite tools.
- No Professional Advice: WaveSuite-generated content does not constitute professional, legal, medical, financial, or other expert advice. You should not rely on AI-generated content as a substitute for qualified professional guidance in any domain.
- Voice Synthesis: CastWave and FlowWave may use AI voice synthesis technology, including voice cloning from user-provided recordings. You represent that you have all necessary rights and consents to use any voice recordings you provide for cloning purposes. You are responsible for compliance with all applicable laws governing synthetic voice content and disclosure requirements.
- Third-Party Platforms: When you connect social media or publishing accounts through PostWave or other WaveSuite products, you are responsible for complying with the terms of service of those third-party platforms. Decoded Systems is not liable for actions taken by third-party platforms, including account suspensions or content removal.
- Content Ownership: Subject to applicable third-party terms and our intellectual property rights in the underlying technology, AI-generated content produced for your account through WaveSuite is your content. Decoded Systems does not claim ownership of content generated on your behalf.
3.5 Media Content
Our published media content, including podcasts, deskbooks, and magazine articles, is provided for informational and educational purposes only. This content does not constitute professional advice of any kind and should not be relied upon as a substitute for professional consultation with qualified experts in the relevant field.
4. Intellectual Property Rights
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio, video, and software code, are the exclusive property of Decoded Systems, LLC or its licensors and are protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use our Services for your personal or internal business purposes, subject to these Terms. You may not reproduce, modify, distribute, or transmit any content from our Services without our prior written permission.
5. User Responsibilities and Acceptable Use
You agree to use our Services only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use and enjoyment of our Services. Prohibited behavior includes:
- Harassing or causing distress or inconvenience to any person
- Obscene or offensive speech or content
- Disrupting the normal flow of dialogue within our Services
- Attempting to gain unauthorized access to our systems or networks
- Uploading viruses or malicious code
- Collecting or tracking personal information of others without consent
- Commercial solicitation or spamming
- Violating any applicable laws or regulations
6. User Accounts and Credentials
If you create an account to use our Services, you are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.
7. Data and Privacy
Your use of our Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our practices regarding the collection and use of your information. By using our Services, you consent to our collection and use of personal information as described in our Privacy Policy.
8. Limitation of Liability
Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so the above limitations may not apply to you in their entirety.
9. Warranties Disclaimer
We do not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any content provided through our Services.
10. Indemnification
You agree to indemnify, defend, and hold harmless Decoded Systems, LLC, its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of our Services
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third-party intellectual property rights
- Any content you submit to or transmit through our Services
11. Modifications to Terms
Decoded Systems, LLC reserves the right to modify these Terms at any time, in our sole discretion. We will notify you of any material changes by posting the updated Terms on our website and updating the "Effective Date" at the top of these Terms. Your continued use of our Services following the posting of revised Terms means that you accept and agree to the changes. It is your responsibility to review these Terms regularly.
12. Modifications to Services
We reserve the right to modify, suspend, or discontinue our Services, or any feature or functionality thereof, at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our Services.
13. Termination
You may terminate your use of our Services at any time by ceasing to access and use them. We may terminate your access to our Services, in whole or in part, immediately and without notice, if we determine that you have violated these Terms or engaged in conduct that is harmful, unlawful, or otherwise inappropriate.
14. Third-Party Links and Content
Our Services may contain links to third-party websites and services that are not operated by Decoded Systems, LLC. We are not responsible for the content, accuracy, or practices of third-party websites. Your use of third-party websites is governed by their terms and policies, not by these Terms. We encourage you to review the terms and privacy policies of any third-party websites before providing your personal information.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any action or proceeding arising out of or relating to these Terms or our Services shall be brought exclusively in the state or federal courts located in King County, Washington, and you irrevocably consent to the jurisdiction and venue of such courts.
16. Dispute Resolution
Before initiating any legal proceeding, you agree to attempt to resolve any dispute with Decoded Systems, LLC by sending a written notice describing the dispute to legal@decodedsystems.com. You and Decoded Systems, LLC agree to negotiate in good faith for a period of thirty (30) days to attempt to resolve the dispute. If the dispute cannot be resolved within this period, you may pursue other remedies available to you under applicable law.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements entered into between you and Decoded Systems, LLC, constitute the entire agreement between you and us regarding your use of our Services and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral.
